### sec.332 Employee stood down in December then re-employed in January
This section applies to an employee, other than a casual employee, who—
is stood down by an employer during December; and
is re-employed by the employer before the end of the next January; and
was employed by the employer for a continuous period of at least 2 weeks immediately before being stood down.
The employer must pay the employee at the ordinary rate payable to the employee immediately before the stand-down for the Christmas Eve (from 6p.m. to midnight), Christmas Day, Boxing Day, and New Year’s Day public holidays between the stand-down and the re-employment.
In this section—
stand-down includes dismissal.

- (b) is re-employed by the employer before the end of the next January; and
- (c) was employed by the employer for a continuous period of at least 2 weeks immediately before being stood down.
