### sec.1003 Application of ch 5, pt 2, div 2 to local government sector Chapter 5, part 2, division 2 does not apply to certification of an agreement for employees of a local government sector employer, if the application for certification of the agreement is made before 1 January 2019. However, subsection (1) does not apply if the commission decides, on an application by a party to the agreement, to apply section 250 in relation to the application to certify the agreement. In this section— local government sector employer see the Fair Work (Commonwealth Powers) and Other Provisions Act 2009 , section 3 (1) .
