57 Training of hoteliers, club secretaries and employees associated with gaming machine activities
> > (1) The Authority is to refuse any application by a hotelier or registered club under section 57 of the Act—
> >
> > > (a) to keep an approved gaming machine, or
> >
> > > (b) to vary an existing authorisation to keep an approved gaming machine,
> >
> > unless the Authority is satisfied that the hotelier or the secretary of the club holds a recognised competency card with a current RCG endorsement and a current advanced RCG endorsement.
>
> > (2) If a hotelier keeps approved gaming machines at the hotel, the following persons must hold a recognised competency card with a current RCG endorsement and a current advanced RCG endorsement—
> >
> > > (a) the hotelier,
> >
> > > (b) the approved manager of the hotel.
> >
> > Maximum penalty—50 penalty units.
>
> > (3) If a registered club keeps approved gaming machines on the club premises, the secretary of the registered club must hold a recognised competency card with a current RCG endorsement and a current advanced RCG endorsement.

> > Maximum penalty—50 penalty units.

> > (3A) A registered club commits an offence if—
> >
> > > (a) the registered club keeps approved gaming machines, and
> >
> > > (b) the secretary of the registered club does not hold a recognised competency card with a current RCG endorsement and a current advanced RCG endorsement.
> >
> > Maximum penalty—50 penalty units.

> > (4) A hotelier or registered club must not employ or continue to employ a person whose duties include the following unless the person holds a recognised competency card with a current RCG endorsement and a current advanced RCG endorsement—
> >
> > > (a) the duties of a responsible gambling manager, or
> >
> > > (b) the duties of a responsible gambling officer for the hotel or club.
> >
> > Maximum penalty—50 penalty units.

> > (4A) A hotelier or registered club must not employ or continue to employ a person whose duties are concerned in the conduct of activities involving approved gaming machines in the hotel or on the club premises unless the person holds a recognised competency card with a current RCG endorsement.
> >
> > Maximum penalty—50 penalty units.
>
> > (4B) A director must—
> >
> > > (a) have completed the following—
> > >
> > > > (i) an approved RCG training course,
> > >
> > > > (ii) an approved advanced RCG training course, and
> >
> > > (b) hold a recognised competency card with the following endorsements—
> > >
> > > > (i) a current RCG endorsement,

> > > > (ii) a current advanced RCG endorsement.
> >
> > Maximum penalty—50 penalty units.

> > (4C) A director does not commit an offence under subclause (4B) in the 3 months after the day on which the director becomes a director.

> > (4D) Subclause (4B) does not apply to a director who has completed responsible gambling board oversight training.

> > (5) In this clause—
> >
> > approved manager has the same meaning as in the [Liquor Act 2007](/view/html/inforce/current/act-2007-090), section 116I(2)(i).

> > director means the following—

> > > (a) a director of a registered club that keeps approved gaming machines,
> >
> > > (b) a director of a company that owns one or more hotels that keep approved gaming machines, if the director is involved in the business operations of any of the hotels.
