### sec.109T Application for approval
A category 2 licensee (the transferor licensee ) for licensed premises (the transferor licensed premises ) may apply to the commissioner for approval of a transfer of entitlements for the licensed premises for the use of the entitlements by the licensee (the transferee licensee ) at other category 2 licensed premises (the transferee licensed premises ) on a temporary basis.
The reference to other category 2 licensed premises in subsection (1) includes a reference to other premises to which the transferor licensee’s licence relates.
The application must be—
in the approved form; and
signed by both the transferor licensee and the transferee licensee; and
accompanied by—
the details of the transfer prescribed under a regulation; and
the fee, if any, prescribed under a regulation.
The commissioner must ensure the approved form includes information about the effect on transferred entitlements of—
the surrender, suspension or cancellation of a transferor licensee’s licence or a transferee licensee’s licence; or
the licensee of licensed premises to which a transfer relates ceasing to conduct gaming at the premises.
The commissioner must grant the application if the requirements mentioned in sections 109U to 109W are satisfied.
If the commissioner grants the application, the commissioner must give the transferor licensee and the transferee licensee written notice of the decision.
The commissioner must refuse to grant the application if the requirements mentioned in sections 109U to 109W are not satisfied.
If the commissioner refuses to grant the application, the commissioner must give the transferor licensee a written notice stating the decision and the reasons for the decision.
