### sec.106 Protection against liability
This section applies to the following persons—
the chief executive;
an authorised officer;
an issuing officer;
a land manager;
an owner of designated fossicking land or land in a fossicking area;
a person who has given someone else permission under this Act to fossick or camp on the person’s land, mining claim or mining lease.
A person to whom this section applies does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
If subsection (2) prevents a civil liability attaching to the person, the liability attaches instead to the State.
