### sec.61RE Approving the application
If the Minister approves the application for division, the agreement to be entered into under section 61QA (1) for the affected area must be on the same terms as the original plantation licence (other than the description of the licence area) unless otherwise agreed by the parties.
However, a proposed plantation licence for the affected area—
must not be for a term of years longer than the unexpired term of the original plantation licence; and
may include a provision linking it and the original plantation licence in the event of default or termination.
Subsection (1) does not apply in relation to any obligation that has been fully performed by the plantation licensee under the original plantation licence.
