### sec.61RD Deciding the application
The Minister must decide whether to approve the application for division.
In deciding the application, the Minister must be satisfied that—
the affected area is sustainable as a commercially viable forestry plantation; and
consents have been given by—
each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and
any plantation sublicensee of the affected area.
The Minister must also consider—
the public interest; and
the extent to which the plantation licensee has complied with the original plantation licence.
The Minister can not approve the surrender under the application and refuse to grant the right under this Act as mentioned in section 61RC (1) (b) .

(sec.61RD-ssec.1) The Minister must decide whether to approve the application for division.
(sec.61RD-ssec.2) In deciding the application, the Minister must be satisfied that— the affected area is sustainable as a commercially viable forestry plantation; and consents have been given by— each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and any plantation sublicensee of the affected area.
(sec.61RD-ssec.3) The Minister must also consider— the public interest; and the extent to which the plantation licensee has complied with the original plantation licence.
(sec.61RD-ssec.4) The Minister can not approve the surrender under the application and refuse to grant the right under this Act as mentioned in section 61RC (1) (b) .
- (a) the affected area is sustainable as a commercially viable forestry plantation; and
- (b) consents have been given by— (i) each registered mortgagee of the plantation licence and any plantation sublicence of the affected area; and (ii) any plantation sublicensee of the affected area.
