### sec.68AB Suspension or cancellation for non-payment of particular fees other than because of dishonoured cheque This section applies if— a fee payable under this Act for or relating to an authority is not paid by the due date for the fee stated in a fee notice for the fee given to the holder of the authority; and the fee is not for an application to transfer or amend the authority; and section 68A does not apply in relation to the non-payment of the fee. The authority is suspended— if the holder of the authority was given the fee notice at least 30 days before the due date—from the due date until the fee is paid or a repayment agreement for the fee is made; or if the holder of the authority was given the fee notice fewer than 30 days before the due date—from 30 days after the notice is given until the fee is paid or a repayment agreement for the fee is made. If the authority is a charter fishing licence or commercial fisher licence, and the authority is still suspended under subsection (2) 90 days after the fee notice for the fee was given to the holder of the authority, the authority is cancelled. In this section— charter fishing licence means an authority that, under a regulation, is described as a charter fishing licence. commercial fisher licence means an authority that, under a regulation, is described as a commercial fisher licence. due date , for a fee payable under this Act, means the date on which the fee is due to be paid under this Act. fee notice , for a fee payable under this Act, means a notice given to the holder of an authority that states— the due date for the fee; and that the authority may be cancelled or suspended if the fee is not paid or a repayment agreement for the fee is not made by the due date. repayment agreement , for a fee payable under this Act, means a written agreement between the holder of the authority and the chief executive for the payment of the fee. s 68AB ins 2006 No. 28 s 28 sub 2024 No. 17 s 143 (sec.68AB-ssec.1) This section applies if— a fee payable under this Act for or relating to an authority is not paid by the due date for the fee stated in a fee notice for the fee given to the holder of the authority; and the fee is not for an application to transfer or amend the authority; and section 68A does not apply in relation to the non-payment of the fee.
