### sec.40 Making urgent declaration or authorising declaration
The chief executive makes an urgent declaration or authorising declaration by publishing it on the department’s website.
The urgent declaration or authorising declaration must—
state whether it is an urgent declaration or an authorising declaration; and
outline the reason for making the declaration; and
be signed by the chief executive.
The chief executive must take all reasonable steps to ensure persons who may be affected by the urgent declaration or authorising declaration are made aware of the declaration.

electronically communicating notice of the declaration (or a copy of the declaration) to holders of relevant authorities, including, for example, by email or SMS
The Statutory Instruments Act 1992 , sections 49 , 50 and 51 apply to an urgent declaration or authorising declaration as if it were subordinate legislation.

(sec.40-ssec.1) The chief executive makes an urgent declaration or authorising declaration by publishing it on the department’s website.
(sec.40-ssec.2) The urgent declaration or authorising declaration must— state whether it is an urgent declaration or an authorising declaration; and outline the reason for making the declaration; and be signed by the chief executive.
