### sec.35 Regulated waters declaration
A fisheries declaration (a regulated waters declaration ) may regulate all or any of the following in particular waters—
the taking or possessing of fish;
engaging in stated activities;
using or possessing a boat, aquaculture furniture, fishing apparatus or anything else.
However, a regulated waters declaration does not apply to an activity authorised by a development approval unless the declaration expressly states that it applies to the activity.
In this section—
waters includes foreshores and nontidal land.

(sec.35-ssec.1) A fisheries declaration (a regulated waters declaration ) may regulate all or any of the following in particular waters— the taking or possessing of fish; engaging in stated activities; using or possessing a boat, aquaculture furniture, fishing apparatus or anything else.
