### sec.164 Chief executive may order forfeiture of particular things
This section applies if—
a thing is seized under this Act; and
the owner of the thing can not be found after reasonable inquiries or, having regard to its value, it is not reasonable to make inquiries about its owner.
This section also applies if—
a thing is seized under this Act; and
the thing contravenes this Act or other fisheries legislation, but a prosecution involving the thing is not started.

In addition, this section also applies if—
a thing is seized under this Act; and
the chief executive is unable, after making reasonable efforts, to return the thing to its owner.
The chief executive may order the forfeiture of the thing to the State.

(sec.164-ssec.1) This section applies if— a thing is seized under this Act; and the owner of the thing can not be found after reasonable inquiries or, having regard to its value, it is not reasonable to make inquiries about its owner.

(sec.164-ssec.3) In addition, this section also applies if— a thing is seized under this Act; and the chief executive is unable, after making reasonable efforts, to return the thing to its owner.
(sec.164-ssec.4) The chief executive may order the forfeiture of the thing to the State.
- (a) a thing is seized under this Act; and
- (b) the owner of the thing can not be found after reasonable inquiries or, having regard to its value, it is not reasonable to make inquiries about its owner.
- (a) a thing is seized under this Act; and
