### sec.119 Occupier must keep particular information for 3 years
Subsection (2) applies to the occupier of a reporting facility for keeping the information used in deciding if the reporting threshold for a substance is exceeded in the reporting period for the facility.
The occupier must keep the information for 3 years after the reporting period ends.
Maximum penalty—20 penalty units.
Subsection (4) applies to the occupier of a reporting facility for keeping the information required to assess the emission data and mandatory transfer data given to the chief executive under section 117 (2) or (7) .
The occupier must keep the information for 3 years after—
the emission data and mandatory transfer data are required to be given to the chief executive under section 117 (2) ; or
if the chief executive requires information under a notice given under section 117 (6) , the period for compliance stated in the notice.
