### sec.118 Reporting period for reporting facility
The reporting period for a reporting facility is—
a financial year; or
if the chief executive decides the occupier of the facility is required to collect or collate data similar to emission data or mandatory transfer data on the basis of a different annual reporting period—the annual reporting period decided by the chief executive.
The chief executive may make a decision under subsection (1) (b) —
on the chief executive’s own initiative; or
on a written application for a particular reporting period (a reporting period application ) made to the chief executive by the occupier.
As soon as practicable after making the decision, the chief executive must give the occupier a written notice (a reporting period notice ) about the decision.
The reporting period notice about the decision is an information notice about the decision if—
the decision has been made on the chief executive’s own initiative; or
the occupier has made a reporting period application and the chief executive has refused it.
If the occupier makes a reporting period application and the chief executive fails to give the occupier a reporting period notice within 40 days after the application is made, the failure is taken to be a decision by the chief executive to refuse the application at the end of the 40 days.
