### sec.38 Duty of person in control of electrical equipment This section applies to a person who is in control of electrical equipment. The person must ensure that the electrical equipment is electrically safe. Subsection (1) does not apply to the person in control of electrical equipment to the extent that the electrical equipment— is located at premises in which the person lives; or forms part of the works of an electricity entity. s 38 amd 2011 No. 18 s 352 (sec.38-ssec.1) This section applies to a person who is in control of electrical equipment. (sec.38-ssec.2) The person must ensure that the electrical equipment is electrically safe. (sec.38-ssec.3) Subsection (1) does not apply to the person in control of electrical equipment to the extent that the electrical equipment— is located at premises in which the person lives; or forms part of the works of an electricity entity. - (a) is located at premises in which the person lives; or - (b) forms part of the works of an electricity entity.
