### sec.163 Compensation for exercise of powers under the repealed Act
This section applies if—
a declaration under the repealed Act, section 23 or 24, is continued in force under section 162; and
a person suffers loss or damage to the person’s property because of the exercise, or purported exercise, of a power under the repealed Act, section 25(2)(a)(i) or (b)(iii) in relation to the declaration.
Despite the repealed Act, section 25(4) and (5), the person may apply for compensation for the loss or damage under section 121 of this Act.
Part 11, division 1, applies to the application as if it were an application for loss or damage because of the exercise, or purported exercise, of a power under section 77(1)(h) or 78(1).
The repealed Act, section 25(4) and (5), does not apply in relation to an application for compensation for the loss or damage.
(sec.163-ssec.1) This section applies if— a declaration under the repealed Act, section 23 or 24, is continued in force under section 162; and a person suffers loss or damage to the person’s property because of the exercise, or purported exercise, of a power under the repealed Act, section 25(2)(a)(i) or (b)(iii) in relation to the declaration.
