### sec.85AB Giving notices by email—agreements
This section applies in relation to a notice that may be given under division 1 , 2 or 4 in relation to an investigation, operation or function, other than—
a notice requiring immediate production of a document or thing; or
an attendance notice requiring immediate attendance at a commission hearing.
The chairperson may enter into an agreement with a person for the purpose of giving notices of a particular type to the person, under this section, by sending the notices to an email address specified in the agreement.

In deciding whether to enter into an agreement with a person under subsection (2) , the chairperson must have regard to—
whether it is appropriate to enter into the agreement; and
the ability of the person to maintain the confidentiality of notices of the particular type proposed to be given by email under the agreement; and
any involvement by the person in an investigation, operation or function to which notices of the particular type relate; and
the number of notices of the particular type proposed to be given by email under the agreement; and
any other matter the chairperson considers relevant.
The chairperson may give a notice to a person by sending the notice by email to the person’s email address specified in an agreement entered into under subsection (2) .
This section does not limit the operation of the Acts Interpretation Act 1954 , part 10 or the Corporations Act.
The Electronic Transactions (Queensland) Act 2001 does not apply to the giving of a notice under this section.
To remove any doubt, it is declared that more than 1 email address may be specified in an agreement mentioned in subsection (2) for the purpose of giving notices of a particular type to a person under this section.
