sec.74Immediate production

### sec.74 Immediate production Despite section 73 (4) , a notice to produce may require a document or thing to be produced immediately if the chairperson believes on reasonable grounds that— delay in producing the document or thing may result in— its destruction, removal or concealment; or serious prejudice to the conduct of the investigation, operation or function; or for a notice given in the context of a specific intelligence operation (crime), delay in producing the document or thing may result in loss of an opportunity to obtain timely intelligence— before a significant event; or that may help prevent a risk to public safety; or for a notice given in the context of the witness protection function, delay in producing the document or thing may threaten— the security of a protected person; or the integrity of the witness protection program or other witness protection activities of the commission. s 74 amd 2002 No. 68 ss 287 , 283 sch 3 ; 2006 No. 41 s 5 ; 2013 No. 64 s 26 ; 2014 No. 21 s 94 (1) sch 1 ; 2016 No. 19 s 45 (1) ; 2016 No. 62 s 39 sub 2024 No. 41 s 12 - (a) delay in producing the document or thing may result in— (i) its destruction, removal or concealment; or (ii) serious prejudice to the conduct of the investigation, operation or function; or - (i) its destruction, removal or concealment; or - (ii) serious prejudice to the conduct of the investigation, operation or function; or - (b) for a notice given in the context of a specific intelligence operation (crime), delay in producing the document or thing may result in loss of an opportunity to obtain timely intelligence— (i) before a significant event; or (ii) that may help prevent a risk to public safety; or - (i) before a significant event; or - (ii) that may help prevent a risk to public safety; or - (c) for a notice given in the context of the witness protection function, delay in producing the document or thing may threaten— (i) the security of a protected person; or (ii) the integrity of the witness protection program or other witness protection activities of the commission. - (i) the security of a protected person; or - (ii) the integrity of the witness protection program or other witness protection activities of the commission. - (i) its destruction, removal or concealment; or - (ii) serious prejudice to the conduct of the investigation, operation or function; or - (i) before a significant event; or - (ii) that may help prevent a risk to public safety; or - (i) the security of a protected person; or - (ii) the integrity of the witness protection program or other witness protection activities of the commission.
