### sec.460 Claims of reasonable excuse
This section applies in relation to a person if—
before the commencement—
the person was given a notice to discover, notice to produce or an attendance notice; and
a requirement was made of the person under the notice to—
produce a document, thing or information to the commission; or
provide information in answer to a question at a commission hearing; and
either of the following applies—
the period within which the person must produce the document, thing or information ends on or after the commencement and the person has not complied with the requirement before the commencement;
the stated time at which the person is required to attend at the commission hearing to produce the document, thing or information, or provide information in answer to a question, is on or after the commencement; and
on or after the commencement, the person makes a claim of reasonable excuse, including privilege.
This Act as in force from the commencement applies to the person.

(sec.460-ssec.1) This section applies in relation to a person if— before the commencement— the person was given a notice to discover, notice to produce or an attendance notice; and a requirement was made of the person under the notice to— produce a document, thing or information to the commission; or provide information in answer to a question at a commission hearing; and either of the following applies— the period within which the person must produce the document, thing or information ends on or after the commencement and the person has not complied with the requirement before the commencement; the stated time at which the person is required to attend at the commission hearing to produce the document, thing or information, or provide information in answer to a question, is on or after the commencement; and on or after the commencement, the person makes a claim of reasonable excuse, including privilege.
(sec.460-ssec.2) This Act as in force from the commencement applies to the person.
- (a) before the commencement— (i) the person was given a notice to discover, notice to produce or an attendance notice; and (ii) a requirement was made of the person under the notice to— (A) produce a document, thing or information to the commission; or (B) provide information in answer to a question at a commission hearing; and
- (i) the person was given a notice to discover, notice to produce or an attendance notice; and
- (ii) a requirement was made of the person under the notice to— (A) produce a document, thing or information to the commission; or (B) provide information in answer to a question at a commission hearing; and
- (A) produce a document, thing or information to the commission; or
- (B) provide information in answer to a question at a commission hearing; and
- (b) either of the following applies— (i) the period within which the person must produce the document, thing or information ends on or after the commencement and the person has not complied with the requirement before the commencement; (ii) the stated time at which the person is required to attend at the commission hearing to produce the document, thing or information, or provide information in answer to a question, is on or after the commencement; and
- (i) the period within which the person must produce the document, thing or information ends on or after the commencement and the person has not complied with the requirement before the commencement;
- (ii) the stated time at which the person is required to attend at the commission hearing to produce the document, thing or information, or provide information in answer to a question, is on or after the commencement; and
- (c) on or after the commencement, the person makes a claim of reasonable excuse, including privilege.
- (i) the person was given a notice to discover, notice to produce or an attendance notice; and
- (ii) a requirement was made of the person under the notice to— (A) produce a document, thing or information to the commission; or (B) provide information in answer to a question at a commission hearing; and
- (A) produce a document, thing or information to the commission; or
- (B) provide information in answer to a question at a commission hearing; and
- (A) produce a document, thing or information to the commission; or
- (B) provide information in answer to a question at a commission hearing; and
- (i) the period within which the person must produce the document, thing or information ends on or after the commencement and the person has not complied with the requirement before the commencement;
- (ii) the stated time at which the person is required to attend at the commission hearing to produce the document, thing or information, or provide information in answer to a question, is on or after the commencement; and
