### sec.438 Hearing—contempt
On the hearing of an application under section 436 (1) (b) to set aside the finding of guilt and any punishment for the contempt imposed by the court under section 199 (8) , the Supreme Court may—
set aside the finding of guilt and the punishment; or
confirm the finding of guilt and the punishment.
The court may have regard to any material relevant to the application.

(sec.438-ssec.1) On the hearing of an application under section 436 (1) (b) to set aside the finding of guilt and any punishment for the contempt imposed by the court under section 199 (8) , the Supreme Court may— set aside the finding of guilt and the punishment; or confirm the finding of guilt and the punishment.
(sec.438-ssec.2) The court may have regard to any material relevant to the application.
- (a) set aside the finding of guilt and the punishment; or
- (b) confirm the finding of guilt and the punishment.
