sec.404Acting part-time commissioners

### sec.404 Acting part-time commissioners This section applies if a person who held an appointment to act as a part-time commissioner immediately before the commencement day— is appointed as a commissioner from the commencement day; or is appointed to act as a commissioner from the commencement day and is appointed as a commissioner from when that acting appointment ends. See section 398 in relation to the continuation of the person’s appointment to act as a part-time commissioner until the commencement day. The period for which the person was appointed to act as a part-time commissioner immediately before the commencement day is to be counted as a period for which the person holds office in the commission as a commissioner for the purposes of section 231(3). Also, if subsection (1)(b) applies, the period for which the person was appointed to act as a commissioner from the commencement day is to be counted as a period for which the person holds office in the commission as a commissioner for the purposes of section 231(3). s 404 ins 2014 No. 21 s 81 (sec.404-ssec.1) This section applies if a person who held an appointment to act as a part-time commissioner immediately before the commencement day— is appointed as a commissioner from the commencement day; or is appointed to act as a commissioner from the commencement day and is appointed as a commissioner from when that acting appointment ends. (sec.404-ssec.2) The period for which the person was appointed to act as a part-time commissioner immediately before the commencement day is to be counted as a period for which the person holds office in the commission as a commissioner for the purposes of section 231(3). (sec.404-ssec.3) Also, if subsection (1)(b) applies, the period for which the person was appointed to act as a commissioner from the commencement day is to be counted as a period for which the person holds office in the commission as a commissioner for the purposes of section 231(3). - (a) is appointed as a commissioner from the commencement day; or - (b) is appointed to act as a commissioner from the commencement day and is appointed as a commissioner from when that acting appointment ends.
