### sec.228 Prior consultation and bipartisan support for appointments
The Minister may nominate a person for appointment to the office of chairperson, deputy chairperson, ordinary commissioner or the chief executive officer only if—
the Minister has consulted with—
the parliamentary committee; and
except for an appointment as chairperson—the chairperson; and
the nomination is made with the bipartisan support of the parliamentary committee.
Within 30 days after the Minister consults with the parliamentary committee, the committee must notify the Minister in writing as to whether the nomination has the bipartisan support of the committee.
However, if the parliamentary committee informs the Minister within the 30 days that it requires more time to consider the matter, the committee must notify the Minister in writing within a further 14 days as to whether the nomination has the bipartisan support of the committee.

(sec.228-ssec.2) Within 30 days after the Minister consults with the parliamentary committee, the committee must notify the Minister in writing as to whether the nomination has the bipartisan support of the committee.
