### sec.219T Requirement to return particular matters to commissioner of police
This section applies if—
the reviewable decision is a decision not to start a disciplinary proceeding under the Police Service Administration Act 1990 , part 7 against an officer in relation to whom a complaint mentioned in section 7 .2 of that Act has been made; and
after reviewing the decision, QCAT sets aside the decision.
QCAT must return the matter to the commissioner of police with—
a direction to start a disciplinary proceeding against the subject officer under part 7 of that Act; and
any other direction QCAT considers appropriate.
If QCAT makes an order under subsection (2) , the commissioner of police must ensure a disciplinary proceeding is started against the officer within 6 months of the making of the order by QCAT.
Subsection (3) applies despite section 7 .12 of that Act.
