### sec.216A Other improper complaints
A person commits an offence if the person—
makes a complaint to the commission—
vexatiously; or
not in good faith; or
primarily for a mischievous purpose; or
recklessly or maliciously; or
counsels or procures another person to make a complaint to the commission as mentioned in paragraph (a) .
Maximum penalty—85 penalty units or 1 year’s imprisonment.
In this section—
make , a complaint to the commission, means—
make a complaint, or give information or matter, to the commission under section 36 ; or
make a complaint, or give information or matter, to another entity that is under an obligation to refer the complaint, information or matter to the commission; or
cause a complaint, or information or matter, to be referred to the commission.

- (a) makes a complaint to the commission— (i) vexatiously; or (ii) not in good faith; or (iii) primarily for a mischievous purpose; or (iv) recklessly or maliciously; or

- (iv) recklessly or maliciously; or
- (b) counsels or procures another person to make a complaint to the commission as mentioned in paragraph (a) .
