### sec.304 Inspector’s power to require information
This section applies if an inspector investigating an incident, or alleged misconduct or alleged corrupt conduct of a staff member, reasonably believes a person performing a function under this Act may be able to give information about the incident or alleged misconduct or alleged corrupt conduct.
The inspector may require the person to give information about the incident or alleged misconduct or alleged corrupt conduct.
When making the requirement, the inspector must warn the person it is an offence for the person not to give the information, unless the person has a reasonable excuse.
The person must give the information, unless the person has a reasonable excuse.
Maximum penalty—40 penalty units or 6 months imprisonment.
It is a reasonable excuse for an individual to fail to give the information if giving the information might tend to incriminate the individual.
