40 Food and drink
(a) sufficient nutritional food and drink are provided for detainees
to avoid hunger and poor nourishment; and
(b) meals are provided for detainees at times consistent with the
cultural norms of Australia; and
(c) clean drinking water is provided to meet the needs of detainees.
(2) The director-general must also ensure, as far as practicable, that
allowance is made for the religious, spiritual and cultural needs of
detainees in relation to the provision of food and drink.
(3) If a doctor, other than a doctor appointed under section 22 (Health
practitioners—non-therapeutic functions), prescribes a particular diet
for a detainee, the director-general must ensure that reasonable steps
are taken to provide the detainee with the diet.
(4) For chapter 10 (Discipline), subsections (1), (2) and (3) are taken to
provide an entitlement for each detainee in relation to food and drink.
(5) Without limiting section 14 (Corrections policies and operating
provision for any of the following:
(a) the nutritional standards to be met by food and drink for
detainees;
(b) the provision of nutritional advice about food and drink
provided to detainees;
(c) the appointment of a nutritionist.
(6) For chapter 10 (Discipline), a detainee’s entitlement in relation to
food and drink includes anything expressed to be an entitlement in a
corrections policy or operating procedure made for subsection (5).
