216 Return of escaped interstate detainee
(1) This section applies if, in the ACT, an interstate detainee attempts to
escape or is arrested after an escape.
(2) The interstate detainee may be taken before a magistrate.
(3) Despite the terms of the interstate detainee’s interstate leave permit,
the magistrate may by warrant (a return warrant)—
(a) order the return of the detainee to the participating State where
the permit was issued; and
(b) order the interstate detainee to be delivered into the custody of a
police officer or interstate escort officer for that purpose.
(4) If a return warrant is issued for the interstate detainee, the detainee
may be kept in detention until the earlier of the following events:
(a) the detainee is delivered into the custody of a police officer or
interstate escort officer in accordance with the warrant;
(b) the end of 14 days after the day the warrant was issued.
(5) The return warrant ends if the interstate detainee is not delivered into
the custody of a police officer or interstate escort officer, in
accordance with the warrant, before the end of 14 days after the day
the warrant is issued.
