328 Secrecy
(1) Except as provided in this section, a person must not directly or
indirectly record, use or divulge any information obtained by reason
of any function that person has, or at any time had, in the
administration of this Act or the Pawnbrokers Act 1980 repealed by
the Consumer Affairs and Fair Trading Amendment Act 1997.

(2) Subsection (1) does not apply to the recording, use or divulging of
information:
(a) in the course of duty; or
(b) under this Part or another law; or
(c) for the purposes of the investigation of a suspected offence or
the conduct of proceedings against a person for an offence; or
(d) with the consent of the person to whom the information
relates, or each of them if there is more than one.
(3) Subsection (1) does not apply to the recording, use or divulging of
statistical or other information that could not reasonably be
expected to lead to the identification of a person to whom it relates.
