### sec.173 Continuing effect of permits under Beach Protection Act, section 44 This section applies to a permit given under the Beach Protection Act , section 44 (3) , and in force immediately before the commencement of the section. From the commencement, the permit, and any conditions of the permit, have effect as if the permit were a development approval in the form of a development permit for a material change of use of premises. Subsection (2) applies despite the repeal of the Beach Protection Act and only to the extent the carrying out of the material change of use of premises could have been authorised under the Beach Protection Act , section 44 . s 173 ins 2001 No. 93 s 19 (sec.173-ssec.1) This section applies to a permit given under the Beach Protection Act , section 44 (3) , and in force immediately before the commencement of the section. (sec.173-ssec.2) From the commencement, the permit, and any conditions of the permit, have effect as if the permit were a development approval in the form of a development permit for a material change of use of premises. (sec.173-ssec.3) Subsection (2) applies despite the repeal of the Beach Protection Act and only to the extent the carrying out of the material change of use of premises could have been authorised under the Beach Protection Act , section 44 .
