### sec.172 Continuing effect of right to use and occupy
This section applies to a sanction to carry out works given under the Harbours Act , section 86 , if, under that section, a right to use and occupy land relating to the sanction is in force immediately before the commencement of this section.
From the commencement, the right to use and occupy the land continues to have effect.
However, the right to use and occupy the land ceases to have effect if, under the Land Act 1994 —
a lease is granted for the land; or
a permit to occupy is issued for the land; or
the land is dedicated as a reserve.

(sec.172-ssec.1) This section applies to a sanction to carry out works given under the Harbours Act , section 86 , if, under that section, a right to use and occupy land relating to the sanction is in force immediately before the commencement of this section.
(sec.172-ssec.2) From the commencement, the right to use and occupy the land continues to have effect.
(sec.172-ssec.3) However, the right to use and occupy the land ceases to have effect if, under the Land Act 1994 — a lease is granted for the land; or a permit to occupy is issued for the land; or the land is dedicated as a reserve.

- (c) the land is dedicated as a reserve.
