### sec.70 Acquisition of land instead of compensation
After a notice of intention to acquire land is served, but before the land is sold, the council may acquire the land instead of paying compensation for injurious affection.
If, after a notice of intention to acquire land is served, the land is cleared of all structures—
the council may acquire the land; and
if required by the owner of the land, the council must acquire the land.
The acquired land must be dedicated for public use as a road within 3 months after its acquisition.
Compensation for the acquisition of the land, if not agreed between the parties, must be assessed as at the date of the acquisition.
(sec.70-ssec.1) After a notice of intention to acquire land is served, but before the land is sold, the council may acquire the land instead of paying compensation for injurious affection.
(sec.70-ssec.2) If, after a notice of intention to acquire land is served, the land is cleared of all structures— the council may acquire the land; and if required by the owner of the land, the council must acquire the land.
(sec.70-ssec.3) The acquired land must be dedicated for public use as a road within 3 months after its acquisition.
(sec.70-ssec.4) Compensation for the acquisition of the land, if not agreed between the parties, must be assessed as at the date of the acquisition.
- (a) the council may acquire the land; and
- (b) if required by the owner of the land, the council must acquire the land.
