### sec.199 Appointing authorised persons
The chief executive officer may appoint a qualified person to be an authorised person.
A person is qualified to be an authorised person if the person—
has the competencies—
that the chief executive officer considers are necessary to perform the responsibilities that are required to be performed by the authorised person; or
prescribed under a regulation; and
is either—
an employee of the council; or
another type of person prescribed under a regulation.
The appointment of an authorised person must state the provisions of this Act for which the authorised person is appointed.
An authorised person’s appointment is subject to the conditions stated in—
the document that appoints the authorised person; or
a written notice given to the authorised person by the chief executive officer; or
a regulation.
(sec.199-ssec.1) The chief executive officer may appoint a qualified person to be an authorised person.
(sec.199-ssec.2) A person is qualified to be an authorised person if the person— has the competencies— that the chief executive officer considers are necessary to perform the responsibilities that are required to be performed by the authorised person; or prescribed under a regulation; and is either— an employee of the council; or another type of person prescribed under a regulation.
(sec.199-ssec.3) The appointment of an authorised person must state the provisions of this Act for which the authorised person is appointed.
(sec.199-ssec.4) An authorised person’s appointment is subject to the conditions stated in— the document that appoints the authorised person; or a written notice given to the authorised person by the chief executive officer; or a regulation.
- (a) has the competencies— (i) that the chief executive officer considers are necessary to perform the responsibilities that are required to be performed by the authorised person; or (ii) prescribed under a regulation; and
- (i) that the chief executive officer considers are necessary to perform the responsibilities that are required to be performed by the authorised person; or
- (ii) prescribed under a regulation; and
- (b) is either— (i) an employee of the council; or (ii) another type of person prescribed under a regulation.
- (i) an employee of the council; or
- (ii) another type of person prescribed under a regulation.
- (i) that the chief executive officer considers are necessary to perform the responsibilities that are required to be performed by the authorised person; or
- (ii) prescribed under a regulation; and
- (i) an employee of the council; or
- (ii) another type of person prescribed under a regulation.
- (a) the document that appoints the authorised person; or
- (b) a written notice given to the authorised person by the chief executive officer; or
- (c) a regulation.
