### sec.13 Who the council is constituted by
Usually, the council is constituted by the mayor and 26 other councillors who are elected or appointed to the council under this Act or the Local Government Electoral Act 2011 .
However—
if all of the councillors have been suspended or the council has been dissolved under the Local Government Act , section 123 and an interim administrator is appointed—the council is constituted by the interim administrator; or
if there are no councillors for any other reason and an interim administrator has not been appointed—the council is constituted by its chief executive officer.

(sec.13-ssec.1) Usually, the council is constituted by the mayor and 26 other councillors who are elected or appointed to the council under this Act or the Local Government Electoral Act 2011 .
(sec.13-ssec.2) However— if all of the councillors have been suspended or the council has been dissolved under the Local Government Act , section 123 and an interim administrator is appointed—the council is constituted by the interim administrator; or if there are no councillors for any other reason and an interim administrator has not been appointed—the council is constituted by its chief executive officer.
