### sec.245L Scope of litigation director review
This section applies to a review about the involvement of the office of the litigation director in a matter concerning the child.
The litigation director must decide the extent of, and terms of reference for, the review.
Without limiting subsection (2) , the terms of reference may include any of the following—
considering whether the office of the litigation director complied with—
legislative requirements; and
guidelines made by the director under the Director of Child Protection Litigation Act 2016 , section 39 ; and
any policies relevant to the performance of a litigation function in relation to the child;
commenting on the adequacy of the legislative requirements, guidelines and policies mentioned in paragraph (a) for performing litigation functions;
commenting on whether sufficient evidence was made available to the office of the litigation director for the purposes of making decisions under the Director of Child Protection Litigation Act 2016 ;
making recommendations relating to matters mentioned in paragraphs (a) to (c) and suggesting strategies to put into effect the recommendations.
The terms of reference must not include considering whether disciplinary action should be taken against an employee of the office of the litigation director.

- (i) legislative requirements; and
- (ii) guidelines made by the director under the Director of Child Protection Litigation Act 2016 , section 39 ; and
- (iii) any policies relevant to the performance of a litigation function in relation to the child;
