### sec.59 Chief executive may issue guidelines for chapter
The chief executive may issue guidelines to facilitate compliance with this chapter.
Before issuing the guidelines, the chief executive must consult on the proposed guidelines as the chief executive considers appropriate.
The guidelines must be published on the department’s website.
In a proceeding for an offence against this chapter, it is a defence for a person to prove—
the conduct constituting the alleged offence is conduct to which the guidelines applied; and
the person complied with the guidelines in engaging in the conduct.

(sec.59-ssec.1) The chief executive may issue guidelines to facilitate compliance with this chapter.
(sec.59-ssec.2) Before issuing the guidelines, the chief executive must consult on the proposed guidelines as the chief executive considers appropriate.
(sec.59-ssec.3) The guidelines must be published on the department’s website.
(sec.59-ssec.4) In a proceeding for an offence against this chapter, it is a defence for a person to prove— the conduct constituting the alleged offence is conduct to which the guidelines applied; and the person complied with the guidelines in engaging in the conduct.
- (a) the conduct constituting the alleged offence is conduct to which the guidelines applied; and
- (b) the person complied with the guidelines in engaging in the conduct.
