### sec.121 Application of part This part applies if a subcontractor intends to claim a subcontractor’s charge on money payable to the contractor for the contract or to another subcontractor for a higher subcontract. For applying this part in relation to money payable to another subcontractor for a higher subcontract— a reference in a provision to a contractor is taken to be a reference to the other subcontractor; and a reference in a provision to the contract is taken to be a reference to the higher subcontract. (sec.121-ssec.1) This part applies if a subcontractor intends to claim a subcontractor’s charge on money payable to the contractor for the contract or to another subcontractor for a higher subcontract. (sec.121-ssec.2) For applying this part in relation to money payable to another subcontractor for a higher subcontract— a reference in a provision to a contractor is taken to be a reference to the other subcontractor; and a reference in a provision to the contract is taken to be a reference to the higher subcontract. - (a) a reference in a provision to a contractor is taken to be a reference to the other subcontractor; and - (b) a reference in a provision to the contract is taken to be a reference to the higher subcontract.
