### sec.96 Extension of lapsing time because of application to extend currency period under Planning Act , s 85 (1)
This section applies if—
a reminder notice has been given under section 95 ; and
before the lapsing time stated in the notice, an extension application is made under the Planning Act to extend the currency period under the Planning Act , section 85 (1) for the relevant building development approval.
For section 95 —
the lapsing time is taken to have been extended until the request has been decided; and
if the currency period is extended past the lapsing time stated in the notice, the lapsing time is taken to be when the extended period ends.

(sec.96-ssec.2) For section 95 — the lapsing time is taken to have been extended until the request has been decided; and if the currency period is extended past the lapsing time stated in the notice, the lapsing time is taken to be when the extended period ends.
- (a) a reminder notice has been given under section 95 ; and
- (b) before the lapsing time stated in the notice, an extension application is made under the Planning Act to extend the currency period under the Planning Act , section 85 (1) for the relevant building development approval.
- (a) the lapsing time is taken to have been extended until the request has been decided; and
- (b) if the currency period is extended past the lapsing time stated in the notice, the lapsing time is taken to be when the extended period ends.
