### sec.246ATL Licensee not to ask for, or receive, reward in particular circumstances
Subsection (2) applies if, immediately before an accommodation agreement is entered into for regulated premises, a pool safety certificate is not in effect for a relevant regulated pool for the premises that is not a shared pool.
A licensee must not, for any activities carried out by the licensee for the entering into of the accommodation agreement, ask for, or receive, a reward for the performance of the licensee’s activities.
A contravention of subsection (2) is not an offence.
However, a failure of a licensee to comply with subsection (2) is, for the Property Occupations Act 2014 , section 172 , a ground for starting disciplinary proceedings against the licensee.
In this section—
licensee means a person in whose name a property agent licence is issued and in force under the Property Occupations Act 2014 .
reward includes remuneration of any kind including, for example, any fee, commission or gain.
