### sec.204 Requirement to destroy removed approved device
This section applies if a person, as permitted or required under this Act, removes from a special designated animal an approved device fitted to the animal.
The person must, as soon as reasonably practicable after the removal, destroy the approved device.
Maximum penalty—100 penalty units.
However, if the specifications decided by the chief executive for the approved device allow for the recycling or re-use of the device, the person does not commit an offence against subsection (2) if the person, within a reasonable period, takes steps to recycle or re-use the device in compliance with any requirements stated in the specifications.
If, having regard to subsection (3) the approved device is not destroyed as otherwise required under subsection (2) , the person must, until the approved device is recycled or re-used, take reasonable steps to ensure the device is kept secure against theft.
