Attorney-General may grant assistance to applicant1
(4) If a person under subsection (1), (2) or (3) applies for assistance,2
the Attorney-General may grant assistance to the person under3
subsection (5) if the Attorney-General is satisfied that:4
(a) refusing the application would involve substantial hardship to5
the person; or6
(b) the circumstances of the case are of such a special nature that7
the application should be granted.8
(5) For the purposes of subsection (4), the Attorney-General may:9
(a) grant legal or financial assistance, or both; and10
(b) grant such assistance that the Attorney-General determines;11
and12
(c) grant the assistance either:13
(i) unconditionally; or14
(ii) subject to such conditions as the Attorney-General15
determines.16
270 Arrangements etc. with the Inspector-General of Intelligence17
and Security18
(1) The Director-General may make written arrangements with the19
Inspector-General of Intelligence and Security, including20
arrangements about one or more of the following:21
(a) information or records required to be kept by the ACIC;22
(b) giving notifications to the Inspector-General;23
(c) giving reports to the Inspector-General.24
(2) Without limiting subsection (1) or any other law of the25
Commonwealth requiring records to be kept or given to the26
Inspector-General of Intelligence and Security, the27
Director-General must:28
(a) ensure the ACIC retains sufficient records relating to:29
(i) the ACIC’s compliance with the laws of the30
Commonwealth and of the States and Territories; and31
(ii) the ACIC’s compliance with directions given under32
section 37 and guidelines made under section 39; and33

(iii) an act or practice of the ACIC that is or may be1
inconsistent with or contrary to any human right, that2
constitutes or may constitute discrimination, or that is or3
may be unlawful under the Age Discrimination Act4
2004, the Disability Discrimination Act 1992, the Racial5
Discrimination Act 1975 or the Sex Discrimination Act6
1984; and7
(iv) the propriety of the ACIC’s activities; and8
(b) give the Inspector-General copies of policies made for the9
purposes of implementing directions given under section 37,10
or guidelines made under section 39.11
(3) An arrangement under subsection (1) is not a legislative12
instrument.13
