264 Termination of employment of ACIC employee for serious17

When this section applies19
(1) This section applies if the Director-General terminates the20
employment of an ACIC employee and the Director-General21
reasonably believes that the employee’s conduct or behaviour or22
any part of it:23
(a) amounts to serious misconduct by the employee; and24
(b) is having, or is likely to have, a damaging effect on:25
(i) the professional self-respect or morale of one or more26
ACIC employees; or27
(ii) the reputation of the ACIC.28

Director-General may make declaration1
(2) The Director-General may, in writing, declare that the2
Director-General has the belief referred to in subsection (1) in3
relation to the ACIC employee.4
Timing of declaration5
(3) A declaration under subsection (2) must be made within 24 hours6
of the Director-General’s decision to terminate the ACIC7
employee’s employment.8
Copy of declaration to be given to ACIC employee9
(4) If the Director-General makes the declaration for the ACIC10
employee, the Director-General must give the ACIC employee a11
copy of the declaration.12

(5) If the Director-General makes the declaration for the ACIC14
employee, the Fair Work Act 2009 (other than Part 3-1 and15
