221 Authorised communications, recordings and dealings3
Authorisation—functions or powers conferred on the ACIC4
(1) The Director-General or an ACIC staff member may communicate5
or make a record of ACIC information, or deal with an ACIC6
record, in the course of performing a function or duty or exercising7
a power under:8
(a) this Act or any other law of the Commonwealth; or9
(b) a law of a State, the Australian Capital Territory or the10
Northern Territory that confers a duty, function or power on11
the ACIC, the Director-General or ACIC staff member.12
Note 1: However, see subsections (5), (6) and (8) for when this subsection13
does not apply.14
Note 2: For the definitions of ACIC information, ACIC record and deal with,15
see section 7.16
Authorisation—functions or powers of other bodies17
(2) The Director-General or an ACIC staff member may, in relation to18
an agency or body mentioned in subsection (3):19
(a) communicate ACIC information to the agency or body; or20
(b) make a record of ACIC information; or21
(c) deal with an ACIC record;22
if the communication, recording or dealing relates, or appears to23
relate, to the proper performance of a function, duty or activity, or24
the exercise of a power, of the agency or body.25
Note 1: However, see subsections (5), (6), (7) and (8) for when this subsection26
does not apply.27

(3) For the purposes of subsection (2), the agencies and bodies are the30
following:31
Division 2 Authorised communication of ACIC information etc.
