### sec.78 Notice to persons not entered in register
This section applies if—
a person has made, or has purported to make, an expression of interest under division 2 ; but
the chief executive considers that, under section 75 (2) , the person’s name may not be entered in the expression of interest register.
The chief executive must give the person a notice (a show cause notice ) stating—
that the person’s name has not been entered in the register; and
why the person’s name has not been entered in the register; and
that the person may, within a stated time of at least 28 days, give the chief executive a written response about entering the person’s name in the register.
The chief executive must consider any response given by the person within the time stated in the show cause notice before deciding whether the person’s name may be entered in the register.
If the chief executive decides the person’s name may not be entered in the register, the chief executive must give the person an information notice for the decision.
