### sec.321 Protection from liability
An official does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the State.
In this section—
official means—
a public service employee; or
an adoption contract worker, counsellor or other person engaged by the chief executive; or
an approved carer; or
an independent Aboriginal or Torres Strait Islander entity, or member of an independent Aboriginal or Torres Strait Islander entity, for an Aboriginal or Torres Strait Islander child.
