147 Order to produce an instrument purporting to be testamentary
(1) The Court may, whether any proceeding is or is not pending in the
Court with respect to any probate or administration, order any
person to produce and bring into the office of the Registrar any
paper or writing, being or purporting to be testamentary, or
otherwise material to the matter before the Court, which is shown to
be in the possession or under the control of that person.
(2) If it is not shown that any such paper or writing is in the possession
or under the control of that person, but it appears that there are
reasonable grounds for believing that he or she has the knowledge
of any such paper or writing, the Court may direct him or her to
attend for the purpose of being examined in open court or upon
interrogatories respecting the paper or writing.
(3) Any such person directed so to attend shall be bound to answer
such questions or interrogatories, and (if so ordered) to produce
and bring in the paper or writing, and shall be subject to the like
process of contempt in case of default in not attending or in not
answering those questions or interrogatories, or not bringing in that
paper or writing, as he or she would have been subject to in case
he or she had been a party to a suit in the Court and had made that
default.
