49P Simultaneous deaths—devolution of property generally
(a) a person who has died (the beneficiary) would, if the person had
not died, have been entitled, under a will or on an intestacy, to
an interest in the estate of someone else who has died (the
benefactor); and
(b) the beneficiary and the benefactor died at the same time or in an
order that is uncertain.
(2) The property of the benefactor devolves as if the benefactor had
survived the beneficiary and had died immediately after the
beneficiary.
