### sec.63A Confidentiality
This section applies to a person who has gained, gains, or has access to, protected information through involvement in the administration of this Act.
The person must not—
record or use the information, or intentionally disclose it to anyone, other than under this section; or
recklessly disclose the information to anyone.
Maximum penalty—100 penalty units or 2 years imprisonment.
The person may record, use or disclose the information—
if expressly permitted or required under an Act to do so; or
for statistical purposes, without revealing, or being likely to reveal, the identity of a person to which it relates; or
in compliance with lawful process requiring production of documents or giving of evidence before a court or tribunal.
In this section—
protected information means information obtained by the chief executive under section 21 .
