Background to the substantive matter
- The Applicant, Omar Zreika was issued with a category AB firearms licence on 12 November 2015, to expire on 31 December 2020, for the purposes of recreational hunting/vermin control. In October 2016, his firearms licence was suspended and, on 11 June 2017, the Respondent decided to revoke the Applicant's firearms licence pursuant to s 24(2)(d) of the Firearms Act 1996 (FA Act) and cl 20 of the Firearms Regulation 2017, that is, on public interest grounds. That decision was affirmed on internal review. On 1 April 2020, the Applicant sought review of the decision (the substantive matter).
- The Statement of Reasons prepared following the internal review recorded: In this regard I believe it is well-known that, to assist their criminal activities, persons of criminal persuasion often seek to make use of licence holders who have minimal or no criminal records, either by purchasing ammunition or storing firearms on their behalf, or by allowing them access to firearms. While I accept that you no longer share a residence with your brother-in-law, and you currently deny that you ever lived at [address], I am satisfied, both from the police report on 17 April 2019, and from the confirmation from your legal representative, you did in fact leave at that location. I am further satisfied that you have close family relationships persons conduct because for serious concern regarding access to firearms and ammunition, which in turn raises serious concerns regarding your own access to firearms and ammunition.
