Background to the substantive matter
- The Applicant, Tania Burn has held a firearms licence since 2009. Her most recent licence was suspended on 14 August 2021. In the meantime, she sought, on 16 January 2020 to renew her licence. On 13 January 2022 her application for a firearms licence was refused, for reasons which included concerns about her mental health and her domestic circumstances. On 8 January (sic) 2022 the Applicant sought internal review of the decision, and then, on 11 February 2022, without waiting for a response, sought review of the decision by the Tribunal (the substantive matter).
Background to this application and Orders sought
- The Tribunal made Orders for the Respondent to lodge material in the substantive matter pursuant to s 58 of the Administrative Decisions Review Act 1997 (the ADR Act).
- The Respondent, by an application pursuant to s 59 of the ADR Act filed on 29 April 2022, sought confidentiality over certain evidentiary material, exemption from the obligation to file and serve certain documents, and Orders in relation to the conduct of the substantive matter. In particular, the Respondent sought the following Orders: 1. Pursuant to s 49 of the Civil and Administrative Tribunal Act 2013 (CAT Act), the hearing of this application, so far as it relates to the Confidential Statement and Confidential Material, be conducted in the absence of the Applicant in the substantive proceedings, any legal representative for the Applicant in the substantive proceedings, and the public. 2. Pursuant to s 59 of the ADR Act, the Respondent not be required to lodge copies of the documents (the Confidential Material) specified in the Confidential Statement provided in support of the application (the Confidential Statement); 3. Pursuant to s 64(1)(c) of the CAT Act, the publication of the Confidential Material and the Confidential Statement or matters contained in the Confidential Material and the Confidential Statement, is prohibited; 4. Pursuant to s 64(1)(d) of the CAT Act, the disclosure of the Confidential Material and the Confidential Statement or matters contained in the Confidential Material and the Confidential Statement, is restricted to the Respondent, the legal representatives for the Respondent and the Tribunal. 5. Pursuant to ss 64(1)(b) and 64(1)(c) of the CAT Act, the publication and reporting of the hearing of this application, including any evidence given during the hearing, is prohibited.
