It was submitted by Mr Bell that as Mr Geschke, Mr Perry and Ms Hughes had not been called to give evidence in relation to documents 1, 4 and 7, I should draw an inference that their evidence and particularly the evidence of Ms Hughes would not have assisted the respondent's case in accordance with the rule in Jones v Dunkel (1959) 101 CLR 298. In my view, the evidence that the respondent was seeking to adduce in relation to these documents was of a general nature, not intended to relate precisely to the circumstances of the Ombudsman's investigations concerning the applicant's complaints. In relation to Ms Hughes, whilst her evidence may have assisted in providing a better understanding of the manner in which the investigation was carried out by the Ombudsman, it is difficult to see how this would have assisted a determination of the central issues in this case. In my view, in such circumstances, it is not objectionable that the respondent did not seek to adduce evidence from those witnesses and, accordingly, I make no inference that their evidence would not have assisted the respondent's case.
