- Special Protection Services (NSW) Pty Ltd ("the Company") has applied for review of the decision of the respondent, the Commissioner of Police ("the Commissioner"), to refuse its application for a Class MB Corporation Master Security Licence under the Security Industry Act 1997 (NSW). The nominated person for the licence in the Company's licence application is Sonya Constantin ("Mrs Constantin"), a director of the Company.
- Mrs Constantin's husband, Nicholas Constantin ("Mr Constantin"), has also applied for review of the Commissioner's decision to refuse his application for a Class 1AC security licence under the Security Industry Act.
- One of the grounds on which the Company's application was refused was that the Commissioner was not satisfied that Mrs Constantin, as a close associate of the Company, was a fit and proper person. Similarly, one of the grounds on which Mr Constantin's application was refused was that the Commissioner was not satisfied that Mr Constantin was a fit and proper person.
